This End User License Agreement (“EULA”) is a legal agreement between you (“you” or “User”) and Peeyush Sahu (“Licensor”, “we”, or “us”) for the PantryTalk mobile application and related software (the “App”).
By downloading, installing, accessing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download, install, or use the App.
This EULA governs your license to use the App software. Your use of PantryTalk cloud features and related services is also subject to the Terms of Service and Privacy Policy. If there is a conflict about the scope of rights granted in the App software itself, this EULA controls.
Subject to your continuous compliance with this EULA, Licensor grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial household use.
You are not buying the App or any ownership interest in it. You are only being granted a limited license to use the App as expressly set out in this EULA. All rights not expressly granted to you are reserved by Licensor.
The App, including its source code, object code, design, branding, trademarks, documentation, and all copies thereof, is and remains the exclusive property of Peeyush Sahu. The App is protected by copyright and other intellectual property laws. This EULA does not transfer any title or ownership rights to you.
Except as expressly permitted by this EULA or applicable law that cannot be waived, you must not:
Licensor may provide updates, upgrades, or patches. Updates may be required for continued use. Unless accompanied by a separate license, updates are governed by this EULA.
The App may integrate third-party services (for example authentication or cloud providers). Those services are subject to their own terms.
If you obtained the App from Apple App Store or Google Play, you acknowledge that this EULA is between you and Licensor only — not with Apple or Google — and that Apple and Google have no obligation to provide maintenance or support for the App, except as required by their store terms. Apple and Google (and their subsidiaries) are third-party beneficiaries of this EULA and may enforce it against you.
This EULA is effective until terminated. Your rights under this EULA terminate automatically if you fail to comply with any of its terms. You may terminate it at any time by uninstalling the App and ceasing all use. Upon termination, you must stop all use of the App and destroy all copies in your possession. Sections that by nature should survive (including ownership, restrictions, disclaimers, liability limits, and governing law) will survive termination.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.
LICENSOR’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) EUR 50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
This EULA is governed by the laws of Germany, without regard to conflict-of-law rules, except that mandatory consumer protection laws of your country of residence may still apply.
Licensor may update this EULA from time to time. The current version will be posted on this page with an updated “Last updated” date. Continued use of the App after changes take effect constitutes acceptance of the revised EULA where permitted by law.
